Offboarding an Employee Without Leaving a Liability Behind

What a UAE employer must close when someone leaves: the MOHRE permit, the residence permit and Emirates ID, the final settlement, and the required order.

An exit gets treated as one event. It is four, and they close in different places on different clocks.

There is the labour side with MOHRE, the immigration side with ICP or GDRFA where the employment visa is cancelled, the money side through payroll, and the records side inside your own business. Companies that treat them as one task usually close two properly, and find out about the other two later. This article sets out what each track requires, the order the authorities themselves impose, and where employment-law questions begin and this article stops.

The order is not yours to choose

Two published rules fix the sequence, and both are commonly discovered the hard way.

The labour side goes first. The UAE Government Portal states that employers must contact MOHRE about the labour contract cancellation before applying to ICP. The immigration cancellation follows the labour one, not the reverse.

Only the sponsor can cancel. The same source is explicit: "Only the sponsor can cancel your residence visa. You cannot process the application on your own." A departing employee cannot do this for you, however cooperative they are. It is the company's transaction.

There is a third rule that applies when the leaver has family on their visa. A sponsor with dependants must cancel the dependants' visas before cancelling their own. If your employee has a spouse and children on their residence permit, those permits close first.

Track one: the labour file, with MOHRE

MOHRE provides the cancellation of work permits and employment contracts as a service to employers. The published requirements are specific, and two of them are worth knowing before you start rather than at submission.

The Ministry requires its cancellation request form, plus documents that vary with the type of cancellation. Where the worker is outside the country, residence visa details are needed. Where a worker has died, the death certificate. Where cancellation follows a contagious disease determination, the medical fitness form.

Then the two that matter most operationally:

An official establishment statement confirming that the worker's rights and dues have been satisfied. You are declaring that the money side is settled.

The employee's signature acknowledging the cancellation and receipt of labour dues, with specified exceptions depending on the permit status.

Those two requirements are the reason the payroll track cannot be left until afterwards. You cannot honestly complete the labour cancellation until the settlement is done.

MOHRE publishes the service as free of charge through its website and smart app, with business centre commission capped at AED 72 if you go through a centre. The Ministry does not publish a service duration for this transaction.

Track two: the money

The published rules here are firm, and they have a date attached.

Final settlement is due within 14 days. The UAE Government Portal states that employers "must pay all outstanding wages, other entitlements and gratuity within 14 days of the termination of the contract."

Gratuity follows Article 51 of the Labour Law. For full-time expatriate workers: no entitlement below one year of service; 21 days' salary for each year between one and five years; 30 days' salary for each year after the first five. The total cannot exceed the wage of two years.

Notice runs 30 to 90 days under Article 43, unless the employee is in probation. During probation the periods are different: an employer terminating gives 14 days' written notice, an employee moving to another UAE job gives a minimum of one month, and an employee leaving the UAE gives 14 days.

The final month still goes through the Wage Protection System. Salaries for the previous month are due on the first day of each Gregorian month, and employers must transfer at least 85 per cent of total wages due on time. A departure does not suspend that.

The governing instruments are Federal Decree-Law No. 33 of 2021, Cabinet Resolution No. 1 of 2022 and, for wage protection, Ministerial Resolution No. (340) of 2026.

Track three: immigration

Once the labour side is cleared, the residence permit is cancelled with ICP or through GDRFA in Dubai.

ICP publishes its fees for cancellation of residency permits: an application fee of AED 50, an exceptional residence cancellation fee of AED 100, smart services fees of AED 100, and a financial guarantee deposit fee of AED 20. Service completion duration is published as two days.

One published figure is worth flagging for a specific situation. Where a sponsor's own residence permit is being cancelled without cancelling their family members' permits, ICP publishes a guarantee of AED 5,000. That is an edge case rather than a routine one, but it catches owners and senior staff who leave while their family stays.

The Emirates ID closes automatically. ICP states that the residence permit and the linked Emirates ID are cancelled together. There is no separate Emirates ID cancellation to chase.

Track four: your own records

Nothing here is a government requirement, which is exactly why it is skipped.

Close the company side: remove the person from your payroll and WPS file, withdraw system and building access, recover company property, and settle anything held against them. Then close the administrative side: return their original documents with a signed receipt, and update your establishment file with MOHRE if the leaver was an authorised signatory or if the establishment's details have changed.

That last one catches growing companies, because an establishment record that no longer matches the payroll causes problems that are hard to trace back to their cause.

Practical asset: the four-track closure checklist. Build one sheet with four columns, headed Labour, Money, Immigration and Records, and list every item above under the right column. Add two fields at the top: last working day, and the date the final settlement was paid. Do not close the labour track until the money column is complete, because MOHRE asks you to certify that it is.

What happens to the person after cancellation

Employers are asked this constantly, so here is the published position, stated carefully.

ICP publishes grace periods in four tiers, counted after the expiry or cancellation of the residence permit:

Grace periodCategory as published by ICP
180 daysGolden, Green and Blue Residence holders and their family members, widows or divorced women of residents, students after completing their studies, and foreign-passport holders who are relatives of UAE citizens
90 daysSkilled workers in levels 1 to 3, and property owners
60 daysResidence permits issued with a guarantor or host
30 daysAll other categories

The UAE Government Portal describes the same rules more loosely, as "flexible grace periods that reach up to 6 months (according to resident category)". Both statements are official. The ICP tiers are the precise version, and a standard employment-sponsored resident who does not fall into a higher tier sits in the 30-day band.

Overstaying attracts a published fee of AED 50 per day, standardised across visit, tourist and residence visas.

Tell a leaver which tier they believe they are in and direct them to ICP to confirm it. Do not calculate it for them. Category determination is the authority's, and getting it wrong for someone costs them money.

When the person has already left the country

This is the scenario that turns a routine closure into a problem, and it is common enough to plan for.

MOHRE's published document requirements anticipate it. Where the worker is outside the country, residence visa details are among the documents required for the cancellation. The Ministry also publishes specific document requirements for other situations: a death certificate where a worker has died, and a medical fitness form where cancellation follows a contagious disease determination.

The difficulty is usually not the paperwork but the signature. MOHRE requires the employee's signature acknowledging the cancellation and receipt of labour dues, subject to specified exceptions depending on the permit status. If the person has already flown home and stopped responding, obtaining that becomes hard.

The preventable version of this problem is simple. Obtain the acknowledgement while the person is still in the country and still engaged with you, during the notice period, not after the final working day. Pay the settlement inside the 14-day window so that there is nothing outstanding to argue about, and get the signature at the same time.

If you are already past that point, go to MOHRE with the facts. The Ministry publishes exceptions for exactly these circumstances, and the route through them is a question for the Ministry rather than for a private provider to improvise.

Keep the establishment record accurate

One habit worth building, for a reason that has nothing to do with any single departure.

Your establishment's record with MOHRE should reflect the people you actually employ. Where cancellations have not been completed, it will not. MOHRE publishes an establishment file update service, completed in two working days for a Ta'qeem fee of AED 406, and keeping the record current is what that service is for.

If hiring is blocked and the reason is not obvious, comparing the permits still registered against your establishment with your actual payroll is a sensible first check. Where the two do not match, take the discrepancy to MOHRE rather than diagnosing it yourself.

Where this article stops

Four things sit outside it, and a provider who answers them casually is a risk to you.

Disputes. If the departure is contested, that is a matter for MOHRE's complaint process and, where relevant, for a UAE-licensed employment lawyer. Nothing here is guidance on how to conduct one.

Whether a particular termination was lawful. That is a legal question about your specific facts.

Settlement calculations for unusual cases. Partial years, unpaid leave, commission structures and alternative end-of-service schemes all have their own treatment. Have them checked.

Penalties. Where non-compliance carries a financial penalty, the amount is set by the authority. We have not published figures for WPS penalties or for failure to cancel, because we did not find an amount on the MOHRE service pages or the UAE Government Portal pages reviewed on 11 September 2026. If a provider quotes you one, ask where it comes from.

Getting the timing right

The pattern that works is simple. Start the paperwork on the day notice is given, not on the last working day.

Use the notice period to confirm the settlement figure, prepare the MOHRE cancellation documents, arrange the employee's signature while they are still present and cooperative, and identify whether dependants need to be cancelled first. Then the labour cancellation can be filed immediately after the last working day, the settlement paid inside the 14-day window, and the immigration cancellation filed straight after.

The alternative, which is what usually happens, is that everything starts after the person has left the country, the signature is impossible to obtain and the file stalls.

If you also want to understand what that employee cost to onboard in the first place, the full per-employee cost breakdown is here. For the wider picture of which authority owns which transaction, start with the transaction map.

Hand us the file on the day notice is given. Send the employee's details, their last working day and whether they have dependants on their visa, and, within what our licensed activity covers, we will prepare the MOHRE cancellation documents, sequence the labour and immigration steps in the order the authorities require, and tell you what has to be signed before the person leaves. Ask us to confirm that scope in writing before you engage us, as you should with any provider. We will quote per file or as part of a retainer, in writing, with government charges shown separately.
